A new bill authored by State Rep. Harrison in the Texas House seeks to establish employer choice of benefits plans by allowing insurers to offer group health plans with fewer state-mandated benefits, according to the Texas Legislature website.

The bill on State Finances category, introduced as HB 139 during the 89(1) legislative session on Monday, July 21, was formally listed with the short title: ’Relating to the repeal of the Moving Image Incentive Program’.

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill creates Chapter 1506 in the Texas Insurance Code to establish “Employer Choice of Benefits Plans,” allowing insurers to offer group health plans that do not include state-mandated health benefits. While these plans are required to cover essential health benefits as defined by federal regulations, they may omit specific state-mandated services, restrictions, or categories of health care providers. The bill mandates that applications and plans clearly inform enrollees of the potential for fewer benefits compared to standard state-mandated plans. Insurers must provide employers with a written disclosure of excluded state-mandated benefits before contracting and must also offer at least one plan that includes all state-mandated benefits. If passed by a two-thirds majority in each legislative house, the bill takes effect immediately; otherwise, it becomes effective on Sept. 1, 2025.

Brian E. Harrison, a member of the House Committee on Appropriations, proposed another nine bills during the 89(1) legislative session. She is also a member of the House Committee on Appropriations – S/C on Articles VI, VII, & VIII and a member of the House Committee on Corrections.

Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
