A new bill authored by State Rep. Harrison seeks to define the jurisdiction and operational framework of the Texas business court system, according to the Texas Legislature website.

The bill on Elections, Special Districts & Authorities, and Taxation category, introduced as HB 40 during the 89(1) legislative session on Monday, July 14, was formally listed with the short title: ’Relating to the vote required in an election to approve an ad valorem tax rate that exceeds a taxing unit’s voter-approval tax rate; making conforming changes’.

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill amends the Government Code to further define the jurisdiction and operational structure of the Business Court in Texas. It clarifies what constitutes a “qualified transaction” and a “fundamental business transaction,” which thresholds jurisdiction with civil actions exceeding $5 million. The bill restructures various Business Court Divisions across specific judicial regions subject to legislative funding and details the concurrent civil jurisdiction it holds with district courts. It defines requirements for judges’ appointment and operational expenses, and mandates the Supreme Court to adopt rules for prompt jurisdiction determination. Additionally, changes address venue establishment for case filing, and the role of the Fifteenth Court of Appeals in jurisdictional matters. Importantly, judges are exempt from certain judicial training unrelated to Business Court’s jurisdiction and may commence employment 30 days prior to begin receiving compensation. Most amendments will apply to civil actions from Sept. 1, 2024. Provisions for compensation and additional appointment procedures are contingent upon legislative appropriations.

Brian E. Harrison, a member of the House Committee on Appropriations, proposed another 74 bills during the 89(1) legislative session. She is also a member of the House Committee on Appropriations – S/C on Articles VI, VII, & VIII and a member of the House Committee on Corrections.

Bills in Texas go through a multi-step legislative process, including committee review, debates, and votes in both chambers before reaching a final decision. Each session, there are typically thousands of bills introduced, but only a portion successfully navigate the process to become law.
